If your family has some correspondence from a famous dead person, and that person has an estate that actively controls their copyright – can you digitise your family heirloom under a CC license?

If you own unpublished material that someone else created, unless you employed or commissioned the creator, they or their estate own the copyright. You may be able to digitise the item under fair dealing provisions of the Copyright Act (e.g. as part of family research), but you can’t licence it under CC or any other licence scheme, in the same way you can’t licence a published copyrighted item you own, such as a paperback novel.
